3 min read

Effective Date: August 14, 2026

1. PURPOSE AND INTERPRETATION

1.1. The "Source of Truth". This Platform Framework Document (the "Framework") serves as the central reference repository for the Pinkdude Master Terms of Service, Privacy Policy, Data Processing Agreement (DPA), and Service Level Agreements (SLA).

1.2. Incorporation by Reference. All capitalized terms used in the "Pinkdude Legal Documents" that refer to a "Contracting Entity," "Governing Law," "Service Category," or "Infrastructure Location" shall have the specific meanings and values defined in this Framework.

1.3. Precedence. In the event of a conflict between a specific definition in this Framework and a definition in the Master Terms, the definition in this Framework shall prevail to ensure global consistency across all regions.

The "Provider," "We," or "Us" in any Agreement refers strictly to the specific legal entity defined below based on the Customer's primary billing address.

2.1. Independent Liability. Each Contracting Entity listed above is a separate and distinct legal person. The Customer agrees that its contractual relationship is solely with the applicable Contracting Entity. No other entity listed in this Matrix (or their parent/subsidiary companies) shall be liable for the obligations of the Contracting Entity.

3. SERVICE CATALOG & DEFINITIONS (WHAT)

The "Services" governed by the Master Terms include any of the following categories that the Customer subscribes to or accesses. New features added to the platform will automatically fall under the most applicable category below.

4. INFRASTRUCTURE & DATA RESIDENCY (WHERE)

To ensure compliance with GDPR, UK-GDPR, and other data sovereignty laws, the Framework defines the physical location of the "Proprietary Cloud."

4.1. Primary Infrastructure Operator. Regardless of the Contracting Entity, the physical infrastructure (servers, networking, storage) is owned and operated by MB Ugauga (Lithuania).

4.2. Data Residency Guarantee.

  • EU Region: Data is stored in Tier-III data centers located within the Republic of Lithuania (European Union).

  • UK Region: Data for UK customers may be cached or stored in the UK or legally transferred to the EU under the UK-EU Adequacy Decision.

  • No Public Cloud Dependency: Pinkdude warrants that it does not rely on third-party public hyperscalers (e.g., AWS, Google Cloud, Azure) for core data storage. All data resides on hardware directly controlled by the Pinkdude Group.

5. SUB-PROCESSOR FRAMEWORK

The Pinkdude Group utilizes a "Shared Services" model. The Contracting Entity may engage other entities within the group to perform specific functions.
