1. GOVERNANCE COMMITMENT
The Platform operates under a structured privacy governance framework designed to ensure lawful, fair, and transparent processing of personal data. This framework establishes accountability at the executive level, integrates data protection controls into operational workflows, and documents the Platform’s commitment to responsible data stewardship. The Platform applies a risk-based approach to data protection governance, aligning controls with the nature, scope, context, and purposes of processing. Governance responsibilities are supported by defined internal roles and escalation paths.
The Platform maintains policies and procedures reasonably designed to support compliance; however, no governance framework can eliminate all risk.
Where required by law, the Platform appoints a Data Protection Officer or equivalent privacy contact.
2. REGULATORY ALIGNMENT
The Platform’s privacy architecture is designed to align with applicable data protection laws, regulations, and industry standards, including but not limited to:
General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679)
UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018
California Consumer Privacy Act (CCPA), as amended by the CPRA
Applicable national data protection laws and evolving regulatory guidance.
The Platform’s controls are structured to meet obligations under these frameworks while adapting to the specific requirements of the jurisdictions in which it operates. Alignment does not represent certification or a guarantee of compliance in all circumstances. The Platform’s governance framework is designed to support compliance efforts but cannot guarantee that processing will be compliant in every circumstance.
3. DATA PROTECTION PRINCIPLES
The Platform operationalizes core data protection principles across its engineering and business processes:
Lawfulness, Fairness, and Transparency: Data is processed only where a valid legal basis exists and in a manner reasonably expected by the data subject.
Purpose Limitation: Data is collected for specified, explicit, and legitimate purposes and not further processed in a manner incompatible with those purposes.
Data Minimization: Processing is limited to what is adequate, relevant, and necessary.
Accuracy: Reasonable steps are taken to ensure data is accurate and, where necessary, kept up to date.
Storage Limitation: Data is retained only for as long as necessary (refer to Document 5.7).
Integrity and Confidentiality: Appropriate security measures are implemented to protect against unauthorized or unlawful processing.
Accountability: The Platform maintains documentation to demonstrate alignment with these principles.
4. LAWFUL BASES FOR PROCESSING
Processing activities are grounded in appropriate lawful bases, including:
Contract Necessity: Processing required to deliver the Services and fulfill contractual obligations to Users.
Legitimate Interests: Processing necessary for platform security, fraud prevention, service improvement, and business operations, where such interests are not overridden by the fundamental rights of data subjects. Where legitimate interests are relied upon, the Platform performs balancing assessments where appropriate.
Legal Obligation: Processing required to comply with statutory requirements (e.g., tax, financial reporting, law enforcement).
Consent: Where required by law, specific processing activities (such as certain marketing communications) are based on verifiable consent, which may be withdrawn by the User.
The applicability of each lawful basis depends on the specific context of the processing activity.
5. DATA SUBJECT RIGHTS FRAMEWORK
The Platform maintains processes designed to enable the exercise of data subject rights under applicable laws, including:
Right to Access: Confirmation of processing and access to personal data.
Right to Rectification: Correction of inaccurate or incomplete data.
Right to Erasure: Deletion of data ("Right to be Forgotten"), subject to retention policies.
Right to Restriction: Limitation of processing under contested circumstances.
Right to Portability: Provision of data in a structured, commonly used format.
Right to Object: Objection to processing based on legitimate interests or direct marketing.
Operational Note: All rights requests are fulfilled subject to identity verification and applicable legal limitations. The Platform reserves the right to deny requests where the identity of the requester cannot be verified or where retention is required by law. Requests are handled within timeframes required by applicable law unless an extension is permitted.
6. PRIVACY BY DESIGN & BY DEFAULT
Privacy considerations are integrated into the Platform’s product development lifecycle and system architecture ("Privacy by Design"). Default settings are configured to support data minimization and user privacy ("Privacy by Default"). This includes:
Integration of privacy reviews during feature development.
Selection of vendors with robust privacy capabilities.
Implementation of security controls proportionate to risk.
7. DATA PROTECTION IMPACT ASSESSMENTS (DPIA)
The Platform conducts Data Protection Impact Assessments (DPIAs) where processing activities are likely to result in a high risk to the rights and freedoms of natural persons. DPIAs evaluate the necessity, proportionality, and risks of processing, along with measures to mitigate those risks. DPIAs are reviewed periodically where processing risks materially change.
8. SECURITY & CONFIDENTIALITY CONTROLS
The Platform implements technical and organizational measures (TOMs) appropriate to the risk, designed to ensure the confidentiality, integrity, availability, and resilience of processing systems. These measures include encryption, access controls, and vulnerability management (refer to Document 5.9 – Security & Encryption Framework).
Security controls are implemented in a manner proportionate to the sensitivity of the data processed. No method of transmission or storage is completely secure, and the Platform does not guarantee absolute security. Security measures are periodically reviewed and updated based on evolving threats, technological developments, and risk assessments.
9. SUBPROCESSOR & VENDOR OVERSIGHT
The Platform maintains a vendor management program to evaluate third-party service providers. Subprocessors are assessed for:
Security posture and certification status (where appropriate to the nature of the services provided).
Privacy capabilities and regulatory alignment.
Contractual safeguards, including Data Processing Agreements (DPAs).
Vendor reviews may be risk-tiered based on the nature of data accessed and services provided.
10. CROSS-BORDER DATA TRANSFERS
Where personal data is transferred to countries outside the European Economic Area (EEA) or the UK, the Platform relies on lawful transfer mechanisms to ensure an adequate level of protection. These include:
Adequacy Decisions adopted by the European Commission or UK Government.
Standard Contractual Clauses (SCCs) and the UK International Data Transfer Addendum.
Data Privacy Framework (DPF) certification (where applicable).
11. BREACH RESPONSE GOVERNANCE
The Platform maintains incident response procedures designed to detect, investigate, and mitigate security incidents. In the event of a confirmed personal data breach, these procedures are reasonably designed to support notification obligations under applicable law.
12. TRAINING & CONFIDENTIALITY
Platform personnel with access to personal data are subject to binding confidentiality obligations. The Platform conducts privacy and security awareness training to ensure staff understand their responsibilities regarding data protection and acceptable use.
13. RECORDS OF PROCESSING
The Platform maintains records of processing activities (RoPA) where required by applicable data protection laws. These records document the purposes of processing, data categories, data recipients, transfers, and applicable retention periods.
14. ROLE CLARITY (CONTROLLER VS PROCESSOR)
Processor Role: The Platform acts as a Data Processor regarding Customer Data processed on behalf of Users to provide the Services.
Controller Role: The Platform acts as a Data Controller regarding User account information, billing data, and marketing usage data required to manage the business relationship.
14.1 SHARED RESPONSIBILITY
Users remain responsible for ensuring that their use of the Services complies with applicable data protection laws, including providing required notices, obtaining valid consents where necessary, and configuring the Services in a compliant manner.
15. CHILDREN’S DATA
The Services are not directed to individuals under the applicable age of digital consent as defined by relevant law. The Platform does not knowingly collect personal data from children. If such collection is discovered, the Platform will take steps to delete the data in accordance with its retention policies.
16. POLICY EVOLUTION
This Framework is subject to periodic review and evolution to align with regulatory changes, technological advancements, emerging threats, and operational developments. Material updates will be communicated through the Platform’s standard notification channels.
17. DATA PROTECTION CONTACT
The Platform maintains channels through which privacy inquiries and data protection concerns may be submitted. Contact details are provided within the Platform Privacy Notice or Trust Center.
18. LEGAL INTERPRETATION
Nothing in this Framework shall be interpreted as creating contractual rights or independent legal obligations beyond those required under applicable data protection law.
This Framework is provided for transparency purposes and does not constitute legal advice.
19. REGULATORY COOPERATION
The Platform cooperates with competent supervisory authorities as required by applicable law and maintains processes to support regulatory inquiries.
