1. PURPOSE AND SCOPE
1.1. Introduction. This Acceptable Use Policy ("AUP") governs the use of all Services provided by the Pinkdude Group ("Provider", "We", or "Us"). This AUP is incorporated by reference into the Master Terms of Service (Document 2.1).
1.2. Zero Tolerance. We maintain a Zero Tolerance policy for abuse. The Provider reserves the right to terminate any account, immediately and without notice, if we determine in our sole discretion that a user has violated this AUP.

(b) No Refund: Accounts terminated for AUP violations forfeit all prepaid fees.
1.3. Vicarious Liability. You are responsible for the actions of any person using your account, including Authorized Users and any end-users of your applications. If your end-user violates this AUP (e.g., sending spam via your hosted script), YOU are liable.

4.1. "Unlimited" Defined. Plans advertised as "Unlimited" (e.g., bandwidth, storage) are subject to this FUP. "Unlimited" means "sufficient for normal business operations." It does not mean infinite. 4.2. Thresholds. If your usage exceeds 300% of the average usage of other customers on the same tier, we reserve the right to:
(a) Throttle your speed;
(b) Ask you to upgrade to a Custom Enterprise Plan; or
(c) Suspend your account until the next billing cycle.
5. FEES, FINES & RECOVERY OF DAMAGES
If your violation of this AUP causes financial or reputational damage to the Provider, we reserve the right to charge your account for administrative and technical costs incurred. You acknowledge that these fees are "Liquidated Damages" reflecting the actual cost of enforcement, not a penalty.
5.1. IP Reputation Damage (The "Spamhaus Clause")
If your actions cause any IP address belonging to the Provider (or its upstream carriers) to be listed on a major Blocklist (e.g., Spamhaus SBL/XBL, SORBS, Barracuda, Microsoft SNDS):
(a) Clean-up Fee: You agree to pay an Administrative Fee of €250.00 per incident to cover the time spent by our Abuse Team communicating with blocklist operators.
(b) Delisting Costs: You are liable for any direct fees charged by third parties to remove the listing.
(c) Termination: We will terminate your account immediately if we receive a "SBL" (Spamhaus Block List) notification linked to your Tenant.
5.2. DDoS Mitigation Costs
If you are the target of a Distributed Denial of Service (DDoS) attack due to your provocative behavior (e.g., hosting "Booter" sites, gambling forums, or IRC war channels):
(a) Null-Route: We reserve the right to "Null-Route" (blackhole) your IP address immediately to protect other customers.
(b) Bandwidth Overage: You may be charged for the ingress bandwidth consumed by the attack if it exceeds your plan's Fair Use Policy.
5.3. Legal Investigation Costs
If we receive a valid subpoena, court order, or warrant requesting data related to your account due to illegal activity:
(a) Processing Fee: We may charge a Legal Processing Fee of €150.00 per hour for the time our legal team spends reviewing, retrieving, and producing the requested data.
(b) Reimbursement: You agree to reimburse us for any external counsel fees incurred in responding to the legal request.
